The valgourmet.com web site was created by the VALGOURMAND company (the " salesman "), which is owner and holder of the entire rights related there to.

The general terms are systematically made available to each purchaser so as to enable him to place an order.

The filling in a purchase order appearing on the Site and the validation by the user of the order (by clicking on the button "Validate my order" aimed at this purpose), is worth full and entire acceptance of these General Terms, which will be the only ones applying to the contract thus concluded.

Applicable law

The parties agree that this contract is governed by French law.

Characteristics of the goods and services offered

The Site continuously contains a commercial proposal for the sale of products, which may not legally be considered as a permanent offer.

Products are confectionery, chocolates, groceries, foie gras, pots, basket makings... The composition of the products is systematically indicated on the relevant pages.

The photographs illustrating the products near to the text may not be considered as contractualy bindinq field. The salesman may not in any circumstances be held liable for any errors contained there in.

The geographical zone of cover of the offer as well as the geographical area of delivery of the salesman are available here.

Period of offer's

Products offers are subject to available stocks and for certain products are only available at specific periods, as indicated at the time of the offer. The maximum weight of an order may not exceed 25kg. Above such weight the customer should contact Valgourmand so as to consider the specific terms of his order.

In the event of out-of-stock condition, the salesman reserves the right to deliver a product with identical characteristics in terms of sizes and quality.

Detailed indication of the price of the good or service offered

The total price indicated on the order confirmation issued by valgourmand is the final price. This price includes the price of the products, the transport and packing, handling charges as well as the taxes for export out of France in the European Union. No other customs duties or VAT will be added to a delivery within the European Union.

Conversion into euro will not affect the validity of the contract. As an indication, the Euro price is systematically displayed at the same time as the price in Francs.

Acceptance of the offer

The Customer undertakes to indicate to valgourmand an address at which delivery can be made during business hours. The Customer  undertakes to pay the price stipulated for valgourmand's services (price of products and transport), as well as to pay or arrange for payment, as the case may be, and directly to the forwarding agent or carrier, customs duties, VAT or other taxes due upon importation of products in the country of delivery (this applies for in certain countries not member of the European Union).

Electronic mail (email) Confirmation by the salesman

After validation of payment, the order is deemed to be accepted by valgourmand. valgourmand will then confirm the acceptance of the order to the customer by electronic mail (email) or any other means available, mail, fax. This confirmation, or as the case may be, the refusal of acceptance of an order will be confirmed to the customer within 24 working hours after the order is received. Moreover valgourmand reserve the possibility of not registering a payment and thus of not confirming an order for any reason including in particular a problem of supply of products, a problem concerning the order received, or any problem concerning the delivery to be carried out.

IMPORTANT : for orders above 300 euros or for orders with shipping outside France, we will ask you to email us scans in jpeg format (do not send bmp files or any other format) of:
1. The front and back of your credit card.
2. An official document showing your name and address as per your order, eg. bank statement, utility bill, driving licence, etc.
The ideal document is a copy of your credit card statement showing the delivery address. Feel free to obsure certain details, eg your signature or certain digits on the card. We will email you again when these scans are received.
If you do not have a scanner, you may fax the copies to us at +33 475 59 19 15 - Please ensure the faxes are clear and legible. Please remember to include your email address on the fax.

If you are not able or do not wish to send these scans, you may pay by bank/funds transfer instead, if you would like to do this, please let us know and we will provide further details.

Retractation period

The retractation period is of seven working days:

for the goods, starting on the day of their reception by the customer, upon provided confirmation of the information by electronic mail (E-mail) has been made.

If the salesman does not respect its obligation to confirm by electronic mail or by any other means, the retractation period is increased to three months as from the day of their reception by the customer.

If within this three month, the confirmation by electronic mail (E mall) is delivered and the customer has acknowledged receipt thereof, the seven working days period runs as from the aforementioned confirmation.

In the event of exercise of the right of retractation, the salesman must refund the sums paid to the customer, without expenses. Refund is due within 30 days maximum.

Payment

Payment is immediate and must be carried out by credit card or upon delivery against refunding only for Metropolitan France, Corsica and Monaco.

Delivery

Delivery is carried out within the period foreseen envisaged upon the direct handing-over of the product to the announced consignee, i.e in the event of absence, by notice of availability.

Delivery periods are indicated as exactly as possible, but are subject to the supply possibilities and to the transport of the salesman.

Delays in delivery may not give rise to damages, withholdings or cancellation of an order.

Transport risks comes to the purchaser, who must make a motivated protest to the carrier within three days from the delivery by registered mail with acknowledgement of receipt.

Guarantees and after-sales service

Any taking-back accepted by the salesman, in the case of apparent defects or of nonconformity of the products delivered, acknowledged by the salesman, will allow the purchaser to get a free replacement or a credit note in his favor, excluding any other indemnity or damages.

Personal information

The customer allows the use of the personal data collected at the terms of this order, in respect of the customers file of the salesman and of the communication of this data to third parties.

In accordance with the law n 78-17 of January 6, 1978, the customer has the right to access and correct this information at any time.

Responsibility limit

The Customer is responsible for the choice of the products, their preservation as from the delivery and their use. In the same time, the VALGOURMAND Company may not be held liable for non respect to regulatory and legal disposals which apply to the country of delivery, the VALGOURMAND Company being only responsible for the respect to the French regulation which apply to the products.

Disputes

Any dispute shall be submitted to the commercial courts of Romans.
